Renewing a Hong Kong Tenancy

Check renewal rights, rent changes, deposits, repairs and guarantors before renewing a Hong Kong tenancy. Includes a copyable confirmation checklist.

Quick answer

First check whether the agreement gives an option to renew, then distinguish exercising that option from negotiating a new arrangement. Record the new term, rent, deposit, equipment and guarantee position; “same as before” leaves important details unresolved.

Read the renewal clause

Check the time, method and conditions for exercising any option. A break right is different from a renewal right. Ordinary private residential negotiations must not be confused with the statutory renewal arrangements for applicable Part IVA regulated tenancies.

Copyable discussion checklist

This requests confirmation; it is not a complete renewal agreement. Mark proposals that remain unagreed.

Property and current agreement: [details]
Current expiry: [date]
Proposed new term: [dates]
Proposed rent and effective date: [details]
Deposit carry-over / settlement: [to confirm]
Repairs, inventory and guarantee: [to confirm]
Please identify agreed items and anything still requiring discussion.

After expiry or agreement

Keep any continued payment, acceptance and correspondence. Do not infer a particular new term or unrestricted right to leave merely because rent continues. Check the actual renewal documents for stamping and the applicable CR109 or regulated-tenancy notification process.
